A. Who we are, and how these terms work
A1. Who we are. SLP Midlands Limited trading as Sandbox Computers, registered in England and Wales, company number 06278810. Shop and contact address: 53 Tunnel Hill, Worcester WR4 9SD. Telephone 01905 673738. Email [email protected]. Registered office: 53 Tunnel Hill, Worcester, Worcestershire, WR4 9SD.
A2. What these terms cover. They apply to everything we supply: goods bought on our website, by phone, by e-mail or in our shop; repairs, upgrades, diagnostics, data transfer and data destruction; second-hand and refurbished goods; and donations. By placing an order, handing us a device, or donating an item, you accept them.
A3. Which terms win. Some things have their own page, which wins over these terms for that subject:
- Computers we build for you: our Custom Build Terms.
- Cancelling, returning and warranty claims: our Returns and Cancellation page and the returns form.
- Prices and ways to receive an order: our Delivery and Collection page.
- How we use your information: our Privacy Policy.
On a job sheet or invoice we give you, any special terms printed there (for example for second-hand goods or parts you supplied) win over these terms for that job.
A4. Your legal rights. If you are a private customer (a consumer), nothing in these terms takes away or limits your legal rights, including those under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. If any term would, it does not apply to you. These terms do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
A5. Changes. We may update these terms. The terms in force on the day we accept your order or take in your device are the ones that apply to that order or job.
B. Buying goods online, by phone or in the shop
B1. Prices. Prices are in pounds sterling. Where we are VAT registered our prices include VAT; where we are not, no VAT is charged and none is shown. The price you pay is the price shown when we accept your order. Before we accept an order, we may change a price, and we may correct a price or description that is wrong. If we find a mistake after you order, we tell you and you choose between buying at the correct price or cancelling for a full refund.
B2. How a contract is made. Your order is an offer. We accept it when we e-mail you to confirm it, or when you collect the goods or we deliver them. We may refuse or cancel an order (for example, if goods are not available, or we suspect fraud) and will refund anything you have paid.
B3. Payment. Payment is due in full when you order, unless we agree otherwise in writing. We accept the payment methods shown at checkout. A deposit agreed in writing is non-refundable except where the law requires, or where we cannot supply.
B3a. Paying with Klarna. If you choose Klarna at checkout, Klarna, not Sandbox Computers, provides and decides on any pay-later, pay-in-instalments or finance option. Whether you are offered it, how much, any fees or interest, any credit check, and what happens if you miss a payment are between you and Klarna, under Klarna’s own terms, which are shown to you before you confirm. We do not provide credit ourselves and do not see or decide on your application. If you cancel or return goods under our Returns and Cancellation terms, or we refund you, we refund through Klarna, and you should also tell Klarna. How you pay does not change your rights against us as the seller (faulty goods, our warranty, your right to cancel).
B4. Delivery and collection. See Delivery and Collection. Delivery dates are estimates. Goods are at our risk until they are delivered to you or handed to you in the shop, and at your risk after that. Ownership passes to you when we have been paid in full. Please check a delivery before you sign for it, and tell us within 48 hours if anything is missing or damaged.
B5. If we cannot supply. If goods become unavailable after your order, we tell you and offer a suitable alternative or a full refund. We are not liable for delay or failure caused by things outside our control (for example, supplier or courier failures).
B6. Computers built to order. Every build on our website is made to order. Read the Custom Build Terms: they explain when you can cancel, what we keep if you cancel after we have ordered parts, and our warranty.
B7. Changing your mind, returning goods, refunds. See Returns and Cancellation. In short: you may change your mind within 14 days of receiving goods bought at a distance, but you must first fill in our returns form and wait for a return number; you pay the cost of returning them; and goods that come back used, installed, damaged or incomplete lose value, and we deduct that loss from your refund, up to the full price. Opened software and licences, and computers built to order, cannot be returned for a change of mind. Goods bought in the shop have no legal right to be returned for a change of mind. We may agree to take them back as a goodwill arrangement, at our discretion, and we deduct a restocking charge of 30% of the price, and any further loss in value if the goods are not in resale condition. (This applies only to goods bought in the shop. It never applies to a legal cancellation of an online or phone order.)
B8. Faulty goods. Goods must be of satisfactory quality, fit for purpose and as described. Within 30 days you may reject faulty goods for a full refund; after that, and within 6 months, we repair or replace them, and if that fails we give a price reduction or refund. We pay the reasonable cost of returning a faulty item, and repair, replacement and sending it back to you are free. After 6 months you may still have rights, but you may need to show the fault was there from the start. We test every return. If goods are tested and found to have no fault, or the damage was caused by you, we say so and explain what we found.
B9. Our warranty. The warranty on a computer we build, on refurbished goods, and on parts we sell, is described on the product page, in the Custom Build Terms and in the Returns and Cancellation page. It is in addition to your legal rights. Parts we sell separately: new parts carry 12 months from us, unless the invoice states a different period, or the maker’s longer warranty where one is stated; used parts carry 30 days, unless the invoice states a different period. This is on top of your legal rights, which it never reduces. The warranty covers failure of the goods in normal use. It does not cover accidental damage, drops or liquid damage, power surges, misuse, unauthorised repair or modification, software problems, or normal wear and tear (including batteries, fans and thermal paste). Please contact us first, using the returns form, so we can put it right quickly.
C. Repairs, upgrades and other services
C1. Estimates and quotes. A figure given before work starts is an estimate, not a fixed price, unless we write “fixed price” against it. If the work needs more than the estimate we stop and ask you before going past it. We do not carry out unrequested work and add it to your bill. Timescales we give are estimates too.
C2. Diagnosis. We may charge to test and diagnose a fault. We tell you the amount before we start, and it is waived if you go ahead with the repair we recommend. Diagnosis is chargeable work even where the fault is not one we can repair economically. If you decide not to go ahead, a diagnostic fee applies for the work already done, and we tell you the amount before we do any chargeable diagnosis.
C3. Faults that were already there. We are responsible for the work we agreed to do and not for the condition of the equipment before it reached us. Equipment often has more than one fault. A second fault showing up after the first is fixed is not a failure of the repair. If we find an additional fault we ask you before doing anything about it.
C4. Call-out, collection and delivery. Call-out, collection and delivery charges are quoted to you before we attend or collect. A call-out charge covers attending and is payable whether or not the fault can be fixed at your premises. If we have to take the equipment back to the workshop, we tell you the likely cost first.
C5. Parts we order specially for you. If we order a part specially for you and then you decide against the work, you pay for the part. We do not order non-stock parts without telling you first.
C6. Our workmanship. Our own work is warranted for 90 days (as printed on our job sheets) from the date of the job sheet or invoice. If the same fault returns within that period because of how the work was carried out, we put it right at no charge. Parts we fitted that we supplied are covered by the warranty on those parts (section B9).
C7. Parts you supply. If you ask us to fit a part you supplied: we give no warranty on it; we do not guarantee it is compatible with your equipment or that it will fix the fault; if it turns out to be faulty, counterfeit or not as sold, the labour to remove, replace or refit it is chargeable, even if it failed the same day; and we are not liable for damage it causes. We check supplied parts for visible damage when we receive them and note anything obvious, but we cannot test a part before it is fitted. Our own workmanship is warranted for the fitting only. By asking us to fit them, you confirm you own the parts, chose them, and accept responsibility for their quality and suitability.
C8. Warranty on repairs does not cover accidental damage, drops or liquid damage, power surges, deliberate misuse, damage caused by anyone else working on the equipment after us, software problems caused by your own settings or installed software, viruses and malware, and normal wear and tear. Any repair or modification by anyone else, without our written permission, ends the warranty.
D. Second-hand and refurbished goods
D1. What second-hand means. Second-hand goods have been used before. They are sold in the condition described on the product page, job sheet or invoice. The description is the agreement: please read it, and tell us before you take the goods if anything in it is wrong. Where we refurbished an item, what we did is listed.
D2. Your legal rights. Second-hand goods must still be of satisfactory quality, as described, and fit for a purpose you told us about. For second-hand goods, quality is judged taking account of age, price and description. Faults we described are not defects you can complain about later. Faults we did not describe are.
D3. Wear is not a fault. Marks, scratches, worn keys, faded casing and reduced battery capacity that are consistent with the age and description of the item are not faults. Batteries are consumable: unless a battery life is stated in the description, none is promised.
D4. Warranty. Used parts and other second-hand equipment: 30 days from the date of sale, unless the invoice states a different period. Refurbished builds carry the period stated on the product page (see Returns and Cancellation). It covers a failure of the item to work as described. It does not cover accidental damage, liquid damage, misuse, unauthorised repair, consumable wear, or software problems after sale. We repair, replace with an equivalent item (which may itself be second-hand), or refund, in that order of preference.
D5. Software and licences. A second-hand computer may have an operating system either transferred with the machine or supplied by us: the product page or invoice says which. We do not supply or guarantee licences for other software, and it is removed before sale.
D6. Batteries and power supplies. Used batteries and used power supplies are the parts most likely to cause harm rather than inconvenience. The battery and fire clauses in section E apply in full to second-hand goods.
E. Batteries, charging and fire risk
E1. Tell us about a damaged battery. If a battery is swollen, leaking, punctured, crushed, has been wet, gets unusually hot, or has hissed, smoked or been dropped hard, tell us when you book the job in. We cannot see inside a battery, and an undeclared damaged cell is a fire risk to your equipment, our workshop and the people in it.
E2. If we find one. We stop, isolate the equipment and contact you. We may refuse to work on, store or return equipment with a battery we consider unsafe until it has been removed. Removal and safe disposal is chargeable unless we are replacing the battery as part of the job.
E3. Charging. Use only the charger supplied, or one of the correct rating from a reputable source. Do not charge equipment unattended, overnight, on a bed, sofa or carpet, or covered.
E4. If anything changes after a repair. If a battery becomes hot or swollen or smells odd, stop using it, disconnect the charger, put the equipment somewhere non-flammable and contact us.
E5. Our position. We are not liable for damage or injury caused by a battery fault you knew of and did not declare, by continued use after any of the signs above, or by charging with an unsuitable or counterfeit charger. Nothing here limits our liability for death or personal injury caused by our negligence.
F. Your data
F1. Back up first. You must back up all of your data before you give us any device, even where the work has nothing to do with your files. We are not responsible for data loss, corruption or deletion unless it is caused by our proven negligence. We take reasonable care but cannot guarantee that all data can be recovered.
F2. Data transfer. If you could not back up, tell us before you leave the equipment. A data transfer (for example from one disk to another) is a separate, chargeable service done on your instruction. You confirm you have the legal right to transfer the data and give us any passwords needed.
F3. Data destruction. Where you ask us for secure erasure or destruction of data, it cannot be reversed: once a drive is erased or destroyed nothing on it can be recovered by anyone. Do not authorise it until you are certain everything you want to keep has been copied and that you have checked the copy opens. You confirm you own the equipment or are entitled to have its data destroyed, and that no legal obligation requires you to keep the data. We do not look at what is on a device first. We overwrite storage so previous contents cannot be read back by normal means, and verify it. A device that fails verification is physically destroyed or returned unerased, as you prefer. We give a written record of the work (device type, serial number where it can be read, what was done, the date). That record is ours, and is not certification to a named standard: tell us before we start if you need that or a witnessed destruction. Some devices cannot be erased reliably (failed drives, some flash devices, encrypted devices without keys): we tell you, and unless you instruct otherwise they are physically destroyed. We deal only with devices listed on the job sheet: check for other things that store data (printers, phones, cameras, memory cards, USB sticks). Tell us within 90 days if you believe the work was not done as recorded. If the data belongs to a business, or is other people’s personal information, you remain the data controller and we act on your instructions as your processor.
F4. Software and settings. You are responsible for the software, settings and configuration on your devices. Faults caused by your own actions (misconfiguration, deleted system files, incompatible software, malware you introduced) are not covered by warranty and may be chargeable to diagnose.
G. Donations, e-waste and disposal
G1. Acceptance. We accept donations of devices, components and storage media at our discretion, and may refuse any. We may ask for proof of ownership.
G2. Ownership. By donating an item you transfer ownership to us. We do not provide valuations unless agreed in writing. We may refurbish, repair, use for parts, resell, give to charity, demonstrate, train with, or recycle it.
G3. Data. We erase storage before refurbishment, resale or disposal. Erasure is irreversible: keep what you need. We give a written confirmation on request where practicable.
G4. Hazardous items and fees. Items that cannot be refurbished are processed as electronic waste under the waste regulations. We may charge a reasonable disposal fee where special handling is needed, and tell you first.
G5. If you ask for a donated item back. Retesting, data destruction, restocking and administrative fees of up to 30% may apply. You confirm you have the right to donate the item.
H. Equipment left with us, and uncollected goods
H1. Collect promptly. Please collect equipment as soon as we tell you it is ready, and pay what is owed. We may keep equipment until the bill for the work on it is paid.
H2. Storage. Equipment left with us for repair or service that is not collected within 7 days of us telling you it is ready may be charged storage at a minimum of £2.50 a day.
H3. Notice before sale or disposal (equipment left with our workshop). If equipment is not collected, we write to you at the address we hold, saying we intend to sell or dispose of it, and give you a reasonable period (at least 28 days) to collect it and pay what is owed. We do not sell or dispose of anything without that notice. If we sell an item to recover what we are owed, anything left over after our charges and the costs of sale is yours and we hold it for you.
H4. Collection orders. If goods you ordered for collection are not collected within 14 days of the date agreed, we may cancel the order and refund you after deducting the costs we have incurred because of the cancellation, where the law allows.
I. Business customers
I1. If you buy as a business, the 14-day right to cancel and the Consumer Rights Act protections for consumers do not apply. You cannot cancel or return goods for a change of mind once we have accepted your order. Faulty goods are dealt with under the warranty and our terms. Our liability to a business is limited to the price of the goods or services concerned, except for death or personal injury caused by our negligence, fraud, or anything else the law does not allow us to limit. We are not liable to a business for indirect or consequential loss, loss of profit, data or business interruption.
J. Liability, complaints, privacy and law
J1. Our liability to you. For a consumer: we are liable for losses you suffer as a foreseeable result of our breaking these terms or our negligence. We are not liable for loss that was not foreseeable, for loss of profit, data or business, or for problems caused by things outside our control. Nothing limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited.
J2. Complaints. If we get something wrong, please give us the chance to put it right: ring 01905 673738 or e-mail [email protected]. We do not currently use an approved alternative dispute resolution (ADR) scheme, but you may still use the courts, and Citizens Advice can help.
J3. Your information. See our Privacy Policy. Devices may be accessed by our technicians for diagnosis and repair. We do not look at personal files except where needed for the repair or a data transfer you asked for, and only with your permission.
J4. Intellectual property. Designs, text, pictures and software we supply remain ours or our licensors’. You must not copy or distribute them without permission.
J5. If part of these terms is invalid. The rest still apply. These terms (with the pages named in A3) are the whole agreement between us for the goods and services concerned.
J6. Law. These terms are governed by the law of England and Wales. Disputes are for the courts of England and Wales, but if you live in Scotland or Northern Ireland you may also use your local courts.
J7. Questions. Ring 01905 673738.
